Can you claim diminished value in Florida?
Yes. Florida treats diminished value as an element of the property damage caused by the at-fault driver. When someone else damages your car, the law entitles you to be put back in the position you were in before, and paying only for the repair does not do that if the car is worth less afterwards because the accident now sits on its permanent record.
The authority: McHale v. Farm Bureau Mut. Ins. Co., 409 So. 2d 238, 239 (Fla. 3d DCA 1982)"the cost of the repairs made plus the diminution in value will ordinarily be the proper measure of damages," with the burden on the plaintiff to prove diminution in addition to repair cost. Meakin v. Dreier, 209 So. 2d 252 (Fla. 2d DCA 1968), the vehicle need not be sold before DV is realized and recoverable.
This is a claim against the other driver's liability insurer, made under their property damage liability coverage. It is separate from, and additional to, whatever that insurer already paid to repair your vehicle. Filing it does not touch your own policy and cannot raise your premium.
Your filing deadline in Florida
Florida gives you 2 years from the date of the accident to bring a claim for damage to personal property, under Fla. Stat. § 95.11(5)(a) (negligence, 2 years); cf. § 95.11(3)(g) (injuring personal property, 4 years). Note that this is the property damage limit, which in many states is different from the deadline for an injury claim. Do not assume the two are the same.

HB 837 (eff. 3/24/2023) moved "an action founded on negligence" from four years to two, now § 95.11(5)(a), while § 95.11(3)(g) still gives four years for "taking, detaining, or injuring personal property." Which controls a negligence-based vehicle DV claim accruing after 3/24/2023 is unresolved. Treat the deadline as TWO years and file early.
In practice you should move much faster than the deadline allows. The limitation period applies to filing a lawsuit, not to sending a demand letter, and negotiating with an adjuster routinely takes four to eight weeks. A claim presented promptly after repairs are finished is also simply more credible than one that surfaces eighteen months later.
Can you claim from your own insurer in Florida?
You cannot recover diminished value from your own collision carrier in Florida. Settled against the insured. In Siegle v. Progressive Consumers Ins. Co., 819 So. 2d 732 (Fla. 2002), the Florida Supreme Court held a policy promising repair or replacement "with other of like kind and quality" does not require the insurer to pay money for diminution in market value once it completes a first-rate repair restoring pre-accident performance, appearance and function. This is the ordinary position in most states: your own policy pays to repair the car, not to compensate the resulting loss in resale value. The claim has to be made against the at-fault driver's insurer.

Two Florida traps: the SOL is now most likely TWO years, not four, for claims accruing after March 24, 2023, and the statutory text is in tension, so file early rather than litigate it; and McHale puts the burden on you to prove diminution separately from repair cost, making a written independent appraisal close to mandatory.
